I do not know the law they are quoting from. Cancelled votes have no electoral value in the computation of election results. Cancelled votes remained cancelled forever.
In 2007 in Edo State, after subtracting the cancelled votes from the valid votes, the Tribunal went ahead and declared Oshiomhole winner on the basis of the valid votes cast while refusing to attach any probative value to the cancelled votes.
I can’t understand the business of cancelled votes in determining the winner of an election.
Perhaps INEC and its employers need to be schooled that a gulf of dichotomy exists between CANCELLED VOTES and CANCELLED ELECTIONS. You can only order a rerun in the case of the latter but certainly not when votes are cancelled.
Cancelled votes are like dead humans that have been drained of blood. They are lifeless and as such cannot add any more value to the process.
They must be allowed to rest peacefully in the dustbin of insignificance without much ado. Or we may wish to ask ‘is INEC going to exhume and resurrect the votes that were cancelled during the ludicrous rerun on the 27th?’. I don’t think they possess the spiritual sanctity to bring that to pass.
PDP should approach the Federal High Court tomorrow with an Originating Summons to interpret Section 179 of the 1999 Constitution of the Federal Republic of Nigeria (As Amended) on whether INEC acted within its legal bounds to have declared a concluded election “inconclusive” or arm herself with Mandamus to compel INEC to declare the results as already collated.
This action should be filed along side an application for either interim or mandatory injunction restraining INEC from going ahead with the preposterous rerun.
This unbridled madness should be stopped before our wobbling democracy is beaded and buried by the tyrants in power!
